Terms of Service / EULA

These Terms of Service ("Terms", "EULA") govern your use of the AlcheMagic mobile game ("AlcheMagic", "the Service", "we", "us"). By installing or playing AlcheMagic, you agree to these Terms. If you do not agree, do not install or play the Service.
These Terms incorporate the Apple Licensed Application End User License Agreement (Apple LEULA) by reference. Where these Terms and the Apple LEULA conflict, the Apple LEULA governs the relationship between you and Apple Inc.

1. Who we are

2. License grant
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Service on Apple-branded devices you own or control, solely for non-commercial entertainment. The license terminates automatically if you breach these Terms.
We retain all intellectual property rights in the Service, including code, art, music, level design, and game mechanics.
3. Account
You sign in via Apple Game Center. You are responsible for your Apple ID security; we never see your Apple ID or password — only a pseudonymous Game Center player id, which we hash before storage (see privacy-policy.md §3).
You may have one account per Game Center identity. You may delete your account at any time from Settings → Account → Delete my account.
4. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or modify the Service (except where permitted by EU Directive 2009/24/EC).
- Cheat, automate, or use external tools to gain unfair advantage (memory editors, packet replay, automated bots).
- Tamper with cloud save data outside the in-app interface.
- Exploit bugs to obtain in-app items or progress not earned through normal play.
- Use the Service to harass, defraud, or harm other users (note: AlcheMagic is single-player; we do not offer multiplayer features at launch).
- Probe or attack our backend infrastructure beyond normal play (e.g., automated rate-limit bypass, credential stuffing).
- Violate any applicable law.
We may suspend or terminate accounts that violate these rules. We log abuse events to the audit log (see privacy-policy.md §3).
5. In-App Purchases (IAP)
The Service offers consumable and non-consumable In-App Purchases via Apple's StoreKit. Apple Inc. is the merchant of record for all IAP. By purchasing, you agree to Apple's payment terms in addition to these Terms.
- Consumables (e.g., currency packs) are credited to your account immediately on successful Apple receipt verification.
- Non-consumables (e.g., permanent unlocks) are restored across devices via Apple's "Restore Purchases" flow.
- Receipts are verified server-side via Apple's App Store Server API (
app/iap/jwsVerifier.js,app/iap/purchaseRoutes.js). - We honor refunds initiated through Apple — see
refund-policy.md.
We reserve the right to adjust IAP prices and offerings. Existing entitlements are not revoked by price changes.
6. User-generated content
The Service does not offer user-generated content publishing at launch. If we add it later, we will update these Terms and the Privacy Policy before the feature ships.
7. Service availability
We aim for the SLOs in ../launch/eu-ios-readiness.md §6.4 (/auth/session p95 < 200 ms, backend availability 99.5 % monthly), but we provide the Service "as is" without uptime warranty. Scheduled maintenance windows are announced in-app where practical.
8. Disclaimers
To the extent permitted by law, the Service is provided "as is" and "as available". We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
EU consumer rights: If you are an EU consumer (Directive (EU) 2019/771), your statutory rights against the seller (us) are not affected by this disclaimer. You retain the right to remedy for non-conformity for 2 years from receipt of the digital content.
9. Limitation of liability
To the extent permitted by law, our total aggregate liability arising from your use of the Service is limited to the greater of:
- The total amount you paid us via IAP in the 12 months preceding the claim, or
- EUR 50.
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost saves, lost progress, or lost in-app currency, except where such liability cannot be excluded under EU consumer law (gross negligence, willful misconduct, personal injury).
10. Termination
You may terminate by deleting your account (Settings → Account → Delete my account) or uninstalling the app. We may terminate or suspend your account for breach of these Terms or for fraud, with notice where practical.
Termination triggers the cascade in account-deletion-policy.md. Retention exceptions for tax / fraud-prevention apply.
11. Governing law and dispute resolution
These Terms are governed by the laws of <!-- TODO-USER: governing-law jurisdiction (e.g. Republic of Estonia) -->, without regard to conflict-of-laws principles.
EU consumers: This choice of law does not deprive you of mandatory consumer-protection rights of the country where you habitually reside (Rome I Regulation Art. 6).

12. Apple-specific terms (incorporation of Apple LEULA)
You acknowledge that:
- Apple has no obligation to provide maintenance or support for the Service.
- Apple is not responsible for product warranties, IP infringement claims (except as Apple's payment processor), or any third-party claims arising from the Service.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
This section satisfies App Store guideline 3.1.2(a) and the Apple LEULA "Application Provider" requirements.
13. Changes to these Terms
We may update these Terms. Material changes (new restrictions on use, new fees) are announced in-app on next launch with a 14-day notice period; continued use after the notice period constitutes acceptance. Non-material changes (typo fixes, contact updates) take effect on publication.
